Terms & Conditions

By downloading or using the 'Path To Infinity' app (hereinafter referred as Service), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, all the content therein, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, belong to 'Cerebrum Games, MB'.

'Cerebrum Games, MB' is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The 'Path To Infinity' app stores and processes personal data that you have provided to us, to provide to provide our game service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the 'Path To Infinity' app won’t work properly or at all.

You should be aware that there are certain things that 'Cerebrum Games, MB' will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but 'Cerebrum Games, MB' cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app. 'Cerebrum Games, MB' is not responsible for any costs associated with your data usage and internet connection, including but not limited to data roaming charges.

Along the same lines, 'Cerebrum Games, MB' cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, 'Cerebrum Games, MB' cannot accept responsibility.

With respect to 'Cerebrum Games, MB’s' responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. 'Cerebrum Games, MB' accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for the both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. 'Cerebrum Games, MB' does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

Termination

'Cerebrum Games, MB' reserves the right, in its sole discretion, to discontinue providing the 'Path To Infinity' app, or any part thereof, with or without notice.

Furthermore, you agree that 'Cerebrum Games, MB' shall not be liable to you or any third-party for any termination or suspension of your access to the 'Path To Infinity' app or any part thereof, removal of information or discontinuation of any aspect of the app.

'Cerebrum Games, MB' reserves the right to modify or discontinue, temporarily or permanently, the Service or any part thereof with or without notice, at any time.

'Cerebrum Games, MB' is not obligated to maintain or support the Service, to provide all or any specific content through the Service, or to provide you with updates, upgrades or services related thereto. You acknowledge that 'Cerebrum Games, MB' may from time to time in its sole discretion issue updates or upgrades to the 'Path To Infinity' app, disable access for any period of time or permanently, and automatically update or upgrade the version of the app that you are using on your device. You consent to such automatic updating or upgrading on your device, and agree that the Terms and Conditions will apply to all such updates or upgrades.

Age Restrictions

By using the 'Path To Infinity' app, you affirm that you are at least 13 years of age. If you are under 13 years of age, you are not permitted to use the app. If you are under the age of consent in your jurisdiction for data processing purposes, or if you are under 16 (where required by law), you must have obtained clear parental or guardian consent to use this app.

If you do not meet these age requirements and/or do not have the requisite parental or guardian consent, you are not permitted to use the 'Path To Infinity' app. 'Cerebrum Games, MB' does not knowingly collect personal data from children under the age of 13, and children under 13 are prohibited from using our app.

Limitation of Liability for Third-Party Services and User Actions

By using this app, you acknowledge and agree that you bear full responsibility for your own actions and any data or content transmitted or received through your use of the 'Path To Infinity'. This game utilizes third-party services - specifically, Google Play Services - for the storage of game-related data including, but not limited to, game progress and game virtual currency (called 'gold bars' in the game).

'Cerebrum Games, MB' does not operate or control these third-party services and thus is not responsible for the management or preservation of user data stored on these platforms. 'Cerebrum Games, MB' cannot guarantee the absolute security and integrity of any data stored or transferred through these third-party platforms and assumes no liability for any loss, alteration, or misuse thereof.

This includes game's virtual currency purchased or acquired through in-app purchases. 'Cerebrum Games, MB' is not liable for any loss of such virtual currency and will not compensate or provide any form of reimbursement in the event such data is lost or corrupted, whether it is due to actions or inactions by you, issues within the third-party platforms, or any other reason.

By downloading or using the app, you expressly relieve 'Cerebrum Games, MB' from any and all liability arising from your use of any third-party service and from any actions taken by you that may impact your game data. It is your responsibility to maintain appropriate backups of your data and to manage your account settings within third-party platforms to safeguard against data loss.

Virtual Goods & Currency

In the 'Path To Infinity' app, users have the ability to acquire 'Gold Bars', which are defined as virtual goods for use within the game environment. These 'Gold Bars' can be obtained through various methods, including but not limited to in-app purchases, gameplay achievements, and viewing of in-app advertisements.

For the purposes of clarity and these Terms and Conditions, 'Gold Bars' have no real-world value and are not a real-world currency. They cannot be exchanged for real money, real goods or services, and they cannot be sold or transferred to anyone. 'Gold Bars' exist solely within the 'Path To Infinity' app, and any quantity of 'Gold Bars' held by a user does not represent any actual property ownership.

All references to 'purchase', 'earn' or 'acquisition' in relation to 'Gold Bars' refer solely to the acquisition of a limited license to use these virtual goods within the 'Path To Infinity' app.

In-app Purchases & Refunds

The 'Path To Infinity' app may include in-app purchases that allow you to buy virtual goods. When you make an in-app purchase, the transaction is processed by the app platform (Google Play Store) on which you downloaded the app. All billing and refund inquiries must be directed to that platform. 'Cerebrum Games, MB' does not have access to your credit card or payment information and does not control the processing of refunds.

Please note that in-app purchases are not necessary to use the app, but they can enhance gameplay and your experience within the app. You acknowledge and understand that in-app purchases are non-refundable and non-transferable, and any purchases of in-app goods cannot be reversed.

In-app purchases may not be available to all users, and 'Cerebrum Games, MB' may, in its sole discretion, set limits on the number of purchases, frequency of purchases, or the amount spent on in-app purchases.

In the event that you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of your payment information or unauthorized usage of your account, you must immediately notify 'Cerebrum Games, MB' and modify your payment information.

You acknowledge that 'Cerebrum Games, MB' is not required to provide a refund for any reason, and that you will not receive money or other compensation for unused virtual goods when an account is closed, whether such closure was voluntary or involuntary.

Dispute Resolution

In the event of a dispute arising out of or in connection with these Terms and Conditions or any contractual or non-contractual obligations arising out of these Terms, the parties shall first attempt to resolve the matter informally through discussion. If the matter is not resolved by informal discussion within thirty (30) days, it shall be resolved by binding arbitration under the rules of the Arbitration Association of the Republic of Lithuania. The arbitration shall be held in Vilnius, Lithuania and conducted in the English language.

Jurisdiction & Governing Law

These Terms and Conditions and any disputes or claims arising out of or in connection with it are governed by and construed in accordance with the law of Lithuania. The courts of Lithuania will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with these Terms and Conditions.

Disclaimer of Warranties

THE SERVICES AND THE MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. 'CEREBRUM GAMES, MB' DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT WITH RESPECT TO THE APP AND MATERIALS, CONTENT, SERVICES AND PRODUCT ON OR ACCESSIBLE THROUGH THE APP.

'CEREBRUM GAMES, MB' DOES NOT REPRESENT OR WARRANT THAT THE APP OR ITS USE: (I) WILL BE UNINTERRUPTED, (II) WILL BE FREE OF INACCURACIES OR ERRORS, (III) WILL MEET YOUR REQUIREMENTS, OR (IV) WILL OPERATE IN THE CONFIGURATION OR WITH THE HARDWARE OR SOFTWARE YOU USE.

'CEREBRUM GAMES, MB' MAKES NO WARRANTIES OTHER THAN THOSE MADE EXPRESSLY IN THESE TERMS AND CONDITIONS, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. Your continued use of the app following any changes will indicate your acceptance of those changes.
